Importance: High Spencer and Amy, How did I miss this section of Code as it relates to CHTC? This is the first time I have ever seen it. We know we issued the first LUCs in error. We have since found that CHTC needs a Site Design Review. This section says that outdoor operations need a Conditional Use Permit too. Since the dryer is unenclosed and the product loading/beginning stage of processing is unenclosed, it seems like a Conditional Use Permit is required. Spencer, do you agree? If so, is there a place to add this in letter to ODA and Circuit Court complaint? Also, since we signed the LUCs in June 2019 without knowing the full extent of their outdoor operations (i.e. that CHTC would be loading product outdoors and using a dryer that was unenclosed), can we cite CHTC for a violation of this section now? Let us know what you think? See some preliminary research below.
