Andy,

I contacted DEQ today to learn the status of your initial complaint. The gentleman I spoke with said it appeared that the complaint is in the DEQ system, but strangely, hasn’t yet been assigned to a staff member.

He said that complaints where the customer requests DEQ follow-up generally get higher priority.

I will file online complaints and share your youtube videos from today.

Hi,

Thanks for the note. Andy has been keeping us informed about DEQ regulations that may apply here. I looked up these standards in early October and also spoke with someone at DEQ who suggested that person who took the original video (Andy) send in an online complaint. Andy did that. Here is a receipt of that complaint Andy forwarded to me on 10/4. He didn’t hear back from DEQ about this complaint because he didn’t ask for any follow-up contact at that time.

I will follow up with another complaint, forwarding Andy’s newest videos. I told Andy today that he is also welcome to submit another complaint.

We appreciate the information and feel like we are keeping up with the issues, as they arrive. We have collected complaint logs from complainants and tracked the dates that qualify as violations or our odor standards. We are also tracking noise complaints, though our nuisance noise code isn’t very strong for commercial or industrial uses. We are collecting the information anyway. CHTC, Inc. is now on notice (as of Wednesday, October 23) that the City is conducting an investigation of their nuisance violations.

I also filed complaints with OSHA, Clackamas County Building, and have talked to DEQ staff three different times by phone and email. Andy submitted the emissions complaint in early October. We will follow up again today.

Yes, these are the Clean Air Act regulations. NESHAP. The air world version of the NPDES permits. Andy
