Yes, it is illegal. Please send to Zinder for resolution. See section 17-3.3.030.D.4. This doesn’t meet access requirements, is an illegal access to the roadway, and it must be removed including the concrete. I wouldn’t have issues with him widening the driveway to his garage to provide additional onsite parking.

Gerald, question for my personal development: how do you approach these odd cases that you’ve never seen before? You seem to always know the answer, but I expect you are using some thinking tools. This must be an illegal driveway because there is no curb cutout, right? In this case the best I can come up with is to just find a code section he’s violating and have Zinder send him a letter?

Andy,

I’m not sure who this should technically go to so I’m throwing it out to two of you. The attached pictures are on Pegasus and the one has what I can assume is an illegal driveway as there is no approach. This “driveway” has a sign that says something to the effect of “don’t block the driveway.” As you can see, these folks leave their garbage cans out 24/7 and several others on that street leave cones etc to save their parking in front of their homes.

I believe this is done due to the large number of folks from the apartments across the street parking on Pegasus but the reality is Pegasus is a public street and they can’t save spots in that manner.
