To whom it may concern,

Attached is an image of one of many signs that your company has illegally placed within the public right of way within the corporate limits of the City of Molalla. Placement of these signs is a violation of at least 3 City codes and each constitutes a separate fine per sign per day that the signs are left in place. The codes are as follows:

18.02.140 Signs requiring a permit.

A. It is unlawful and a civil infraction for any person to erect, construct, alter or relocate any sign without first obtaining a permit pursuant to the provisions of this chapter unless a provision of this chapter specifically exempts a sign from the permit requirement.

B. It is unlawful and a civil infraction for any person to construct a sign that is not specifically allowed by this chapter or to erect, construct, maintain or allow to exist a sign in violation of the terms of the permit issued pursuant to this chapter. (Ord. 2018-12 §2)

18.02.090 Prohibited signs.

C. No permanent sign, other than a public sign, may be placed within or over any portion of the public right-of-way, except those signs which are consistent with the provisions of this chapter.

Q. A sign erected or maintained on public property or within the public right-of-way without permission of the public body having jurisdiction.

W. Signs in violation of the other chapters of the Molalla Municipal Code. (Ord. 2019-02 §§3, 4; Ord. 2018-12 §2)

5.24.019 Contractors’ and subcontractors’ responsibility.

It shall be the responsibility of all general contractors, utility companies and subcontractors working in the city to obtain a business license. It shall further be the responsibility of all general contractors and utility companies working in the city to provide a list of all names and addresses of subcontractors under their direction. Failure of any subcontractor to obtain a license may result in a stop work order on any project within the city’s jurisdiction.( Ord. 2018-04 §1; Ord. 2013-07 §1)

1.04.010 Designated.

A. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of any ordinance of the city is guilty of a violation. Except in cases where a different penalty is prescribed by any ordinance of the city, any person found in violation must pay a fine not to exceed $1,000.00.

B. Each such person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the city is committed, continued or permitted by any such person, and he or she shall be punished accordingly. (Ord. 2011-01 §1; Ord. 1982-3 §2)

You have until 11:59 PM, Monday, May 27, 2019 to remove all signs within the corporate City limits of Molalla. Any sign found in the right of way any time after 8:00 AM, Tuesday, May 28, 2019 will be documented by Code Enforcement and your company will be cited into Municipal Court and charged with any and all offenses provided under City code. Your response and resolution of this matter will be forwarded to the City Prosecutor. Thank you for your immediate cooperation.
