I wanted to let you know that my husband and I can now smell the putrid smell of the rotting garbage from the trailer at 806 Toliver Road in our living room and kitchen. When there's a fog layer, it's intensified.

We know they had until November 21st, 2016 to clean up the trash, which has passed. Please let us know the status of this at your earliest convenience, and if there's anything else we can do to assist.

Dan,

That sounds like a sound plan. Makes total sense. My husband and I saw a few regulations regarding the firewood pile itself and its view from the street, but the added instability and being built of improper materials does fall into another category. When we first bought the house in 2010, Mr. Parish was friendly towards us and told us he planned to take down the structure. When that didn't happen, I asked a couple of gentlemen from the city (I'd have to check my records to see who) to come out to take a look at it. At that time, it was a lean-to covered with a tarp. I was told at that time that there might be an issue with the lean-to blocking the view to the entrance of the shared driveway, that there could be fence bordering the edge of the property where the heap is but it had to be 42" twenty feet back. That's something we'll consider as this goes along. In other municipalities we've worked for, we know the structure itself could be categorized as solid waste. Whatever it is, it's dangerous and has been a hideous view from my living room window. Needless to say, I leave the living room drapes closed at all times.

The fence...yes, it is the additional height but it's also a safety issue because they basically took wood from a discarded fence (that was wet and covered in green slime in their burn pile) and nailed the beams onto the existing fence with the wrong length of nails, leaving us with numerous protruding nails on our side of the fence at varying heights. Your idea about tacking that into the council request makes sense.

A brief history if I may: We waited to report the fence and lean-to heap issues because the homeowner has exhibited unstable behavior and we've heard heated arguments and what sounds like walls or doors being smashed inside the residence. The children who lived there previously nearly caught our house on fire while they enjoyed a bonfire in their backyard without adult supervision. When my husband tried to speak to their mother about it the issue and about the illegality of leaving the children unattended with a bonfire, he told her he was speaking from experience as a police detective and had seen too many families hurt or killed in house fires. What was a pleasant neighbor situation immediately changed, and the addition to the fence was added soon after when we had to call the fire department for help with another unattended. Since the homeowner, the small children and their mother have vacated the premises, we feel it's time to get help. The homeowner may be abandoning the place, as we understand there's a delinquent tax issue.

Hi Lori,

Procedure for “Dangerous Buildings” is different from a nuisance procedure in that we have to get a hearing before Council with the property owner. My tack was to get the letter out for the junk/attractive nuisance/stray materials/waste issues ASAP. As I am not a building inspector/official, I’ll look whether a report from me would satisfy the requirement to get a hearing with City Council early next week.

Regarding the fence – this is the “additional height” they’ve added, correct? While a violation, again I wanted to get them taking care of the more pressing issue of removing the accumulated waste. We will address it in time – can probably tack it on to the Council request.

We sent out a letter this morning requiring abatement regarding the many nuisance violations. They have a 10 day period to abate, (essentially until Monday, the 21st since I am not in the office during the weekend when the 10 day ends) to abate. I want to at least see progress by that point with the big ticket items gone. If not, the City escalates towards abatement.

Building related issues are beyond my scope. Likewise, if there is illegal activity (as opposed to nuisance code violations) going on at the premises please contact the Molalla Police Department dispatch – 503-655-8211 or 911 in the event of an emergency.

I have additional information on the problem at the 806 Toliver Road residence. When one of the vehicles were gone yesterday, I could see that the black garbage bags are also being accumulated on the front porch facing Toliver Road and on the side porch adjacent to the driveway. Looking closer at one of the photos I provided in my complaint document, the bags can be seen on the side porch.

I learned from another neighbor that there is a massive mold problem inside the residence, and one bedroom closet is completely coated with mold on the interior. I am providing this information as an officer safety warning in case any responders enter the residence.
