Hi Dan Z,

We don’t yet know if they were in the drainageway again, but if they violated anything related to the drainageway then they shall be cited into court with the prosecutors blessing.

My recommendation to the prosecutor shall include a wetland delineation that will be filed with DSL for their concurrence, design and construction of restoration of disturbed wetland from off-road activities by inhabitants, and perimeter of the wetland shall be permanently fenced with a man gate access for maintenance by property owner. Additional recommendations may include a written report annually by a wetland scientist on protection and maintenance needs of drainageway to which the property owner will be responsible for all costs and any maintenance needs from that report. All reports and work shall be done to the satisfaction of the Public Works Director.

This is the letter that I sent to the Clowers when the complaint was in regards to the ATV/Vehicle interference with the drainage area. Basically, I couldn’t find anything in the code that prohibited ATV use specifically but the noise, dust, and wetland issues essentially prohibited what they had been doing at that time.
