Gerald,
I found no trace of any land use action or approval on the subject 3 properties. What I found:
Clink Scales has three sites all owned by Carter Frost LLC.
116 Shaver
122 Shaver
421 W Main St
He uses all of these lots for the porta potty business and another lot at 419 W Main St.
There is a wash station at 122 Shaver with a visible sanitary vent to the roof.
There is an active water billing account at 122 Shaver which pays a water bill but no sewer bill. There is a note in the file for deal by Marc Howatt which states that they are deactivated on all but water base and storm. There is a sewer lateral to this site and the wash station must drain somewhere.
Next Steps: I think PW is going to investigate the sewer line and see if its in use and if the wash station is connected to the sewer or storm system.
I was thinking we could ask Carter Frost if he went through any type of land use approval. Is this an ok approach or not?

Hi Josh,
This one has issues for us also. Aldo and Brenda are researching whether the things done to the property have planning approvals from the past. There is also a stormwater issue for the property. If they want to take access off of the state highway thru what is now a residential property in a industrial zone then that will change the use and may trigger frontage improvements for all of the affected parcels. Will know more as time goes on. Thanks Josh.

Hi All –
ODOT has determined that we cannot require a new Approach Permit based on the Change of Use criteria. But we will be recommending that the access to the Highway be closed and access (ingress/egress) from Shaver Avenue. This is a recommendation and ODOT cannot require, the City would need to determine if local code supports closure of access. If the City cannot/does not require closure of the access to the Highway, ODOT would recommend that the access be paved for commercial use, which will require an Approach Upgrade Permit.
