Good catch I didn’t check business license I assumed it was not active since its all boarded up.

However it is approved for boarding or rooming. Accessory Dwelling as special use with that said Aldo should weigh in on it. I could be interpreting incorrectly. Because it may have to be first a business and then as accessory living which is highly probable.

Just my thoughts.

A few other issues on this property:

5.24.010 Definitions. As used in this chapter of the Molalla Municipal Code, the following words and phrases mean: A.“Business” means an activity carried on by a person predominately for economic profit or livelihood in the city including professions, trades, occupations, and shops. Any person who advertises or otherwise represents themselves to the public as engaged in business is presumed to be so engaged.

She maintains an active business license but doesn’t meet our definition of a business. Her business is boarded up and has been for years.

In addition, she is living in a commercial building. She pays for a commercial utility account, not supposed to be living there.

We regularly receive complaints about the property. In years past she used to put lawn furniture and a little table on the sidewalk for morning coffee. Now, we receive complaints about the boarded up windows and caution tape and the unsightly appearance of the property. I have not seen Molalla Avenue access to that building for years, must be accessing from the back of the building.

Gerald, correct, the Crew has done no work in that alley according to work order records or memory. I did walk back there when we got a report of someone “digging around” a few months back, but saw nothing out of the ordinary. The residents of 112/114 were doing some cleanup and installing a cheap fence, but that’s all I saw. I spoke with one of their family members briefly and told him I was checking on a report of “someone digging around” but that didn’t see anything out of the ordinary. He stated his neighbors were “after him” but I told him it didn’t appear to be my concern. He asked me if he could get a copy of my “report”, but I told him there would be no report. The only public records I have on the issue is confirming with Ginger that the Meter at address 112 is off back on 10/9/18. Water is supplied to both properties (since the building spans the line) through the meter to address number 114. Again, I couldn’t confirm any wrongdoing.

I am not aware of any work that we have done that would have dug up a property pin (Andy correct me if you and the crew remember doing any work there) but I do remember a plumber working on the Sundowner Bar and MJ Dispensary next to it as part of their plumbing clean-up work. It smells like they want someone else to pay for establishing their property corner locations.

I agree with Brenda that the survey from 2010 shows the property pins found and that prior to that date they were either not set prior to the 1913 City survey map or they were removed prior to 2010. Either way the City is not responsible for resetting the property pins and we are not responsible for locating their property corners. They can hire a surveyor, just like everyone else, to determine their property corner locations.

A better question is why haven’t we acted on the lien from 2011. Sounds like they owe the community money with interest and need to pay the community back.

  3. Location of the right-of-way.
