Hi Mac,

Below is copy from ODOT’s IOF IGA that the City of Molalla would need to sign. According to the IGA, ODOT would need to receive an executed copy of the Maintenance Agreement for S. Molalla Avenue before funds could be dispersed.

1. Recipient shall, at its own expense, maintain and operate the Project upon completion and throughout the useful life of the Project at a minimum level that is consistent with normal depreciation or service demand or both. The Parties agree that the useful life of the Project is defined as seven (7) years from its completion date (the “Project Useful Life”). For any portion of the Project that is not within ODOT’s or Recipient’s jurisdiction (the “County Portion”), Recipient shall enter into a maintenance agreement with the county having jurisdiction over the County Portion (the “Maintenance Agreement”). The Maintenance Agreement must designate the entity that will maintain the County Portion for the Project Useful Life. No Grant Funds will be disbursed until ODOT receives an executed copy of the Maintenance Agreement. This paragraph shall survive any expiration of this Agreement.

The jurisdictional transfer was in reference to the property. I’ve asked ODOT’s statewide office if the signed ordinance would be sufficient for ODOT’s records. I’ll let you know how they respond.

Awesome, thank you. I was also trying to get some clarity on what you mean by this:

“They also informed me that ODOT will need a copy of the jurisdictional transfer from the annexation for our records but it does not need to be completed prior to the IOF agreement being executed.”

I’m trying to ascertain whether you mean a jurisdictional transfer of the roadway or the private property. The reason I ask is that the roadway will not be transferring jurisdictions, it is and will remain in Clackamas County jurisdiction.

Hi Mac,

Are you certain that we need an IGA for the request of these funds? It seems like all we need to do is confirm that the County will maintain the assets under its jurisdiction/accepted maintenance and I don’t think we need an IGA for that as that is already our obligation. I discussed this with our Counsel. What about a confirmation email or letter that confirms that we have jurisdiction and we maintain it?

Hello All,

Please find attached first draft of IGA between Clackamas County and City of Molalla. The IGA is intended to meet ODOT’s requirement for a written maintenance agreement for roadway projects funded by IOF funds. This agreement is for the County to maintain improvements along the County roadway that would be (if awarded) partially paid for by ODOT Immediate Opportunity Fund proceeds. The IGA also provides that the City would maintain any portion that is currently, or comes into City jurisdiction.
