Attachments: Dansons - Molalla - IOF Memo.pdf; 21-003 - Topo-11x17.pdf; Good Morning, The City is attempting to obtain an Immediate Opportunity Fund grant from ODOT to assist Dansons Company in completion of frontage improvements along their frontage of S Molalla Ave, which is in the County. In order to obtain the grant, we are required to have an agreement signed by the County that you will maintain the improvements (e.g. you will maintain your roadway). I emailed Cindy Moore on this last week and she pointed me in your direction. Here is the information provided by ODOT as to what they need in order to grant the funds, the highlighting was done by ODOT: “I received the information below about how to proceed given the IOF project/S. Molalla Ave. is and will not be in the City of Molalla. Let us know how you’d like to proceed.
Recipient shall, at its own expense, maintain and operate the Project upon completion and throughout the useful life of the Project at a minimum level that is consistent with normal depreciation or service demand or both. The Parties agree that the useful life of the Project is defined as seven (7) years from its completion date (the “Project Useful Life”). For any portion of the Project that is not within ODOT’s or Recipient’s jurisdiction (the “County Portion”), Recipient shall enter into a maintenance agreement with the county having jurisdiction over the County Portion (the “Maintenance Agreement”). The Maintenance Agreement must designate the entity that will maintain the County Portion for the Project Useful Life. No Grant Funds will be disbursed until ODOT receives an executed copy of the Maintenance Agreement. This paragraph shall survive any expiration of this Agreement.
The County will not be a party to the IOF agreement.”
As you can probably guess by the grant name, this is a relatively pressing matter as the grant is purposed for immediate opportunities and needs to be worked out prior to permitting/construction. As an aside, the property owner had been discussing proportionality and this grant also mitigates any concerns around that.
Please let me know if either of these options sounds doable for you, or if there’s some other way you’d like to proceed. I appreciate your help and expeditious attention to this.
