Hello everyone,

I hope you are all doing well and staying safe!

I wanted to share that the project received land use approval at the end of April. Unfortunately, the decision was appealed by a community member. To address the appeal, there will be a Land Use hearing on July 13th. We are still evaluating our best path forward in an effort to keep any schedule delays to a minimum but we have to be prepared to address design changes that may result from this appeal.

I will keep you all posted on progress.

Cindy and all,

The project team submitted revised project information and requested follow up to BDS for our Type 2 Environmental Review last week Friday. We should receive any comments by the end of March and barring any issues, BDS may issue a draft decision then. Final decision, if no appeal should be by the end of April. I will keep you all posted and please feel free to reach out to me, if you’d like additional information on this submittal.

Thank you Britta. I suggest frequent and transparent communications with regulatory agencies on this project, given its troubled past and present. Since the schedule has already slipped by over a month and there have been no updates or revised submittal dates provided, it could be perceived as Parks being out of compliance or breaking verbal agreements. Of course unexpected challenges come up on all projects; that is the fun of project management! I just request transparency as we move forward, given that this project overlaps with other important work the City is trying to accomplish.

Thanks for checking in. The design team is working through a couple more comments and items related to the deduction in scope. It is taking a bit longer than I optimistically anticipated back in January.

Also, we just learned that the Army Corps has taking jurisdiction over all wetlands on site BUT there is a potential legislative change from DC which may change all of that once the legislative direction becomes official. The design team is now trying to think through this potential change and any implications for the project.

We’re also still waiting to hear back from Alex on her approval of our testing from last spring to include that bit of info in the submittal.

HI Britta,

I wanted to check in on the LU submittal again for the Forest Park site. To my knowledge, there have been no new submittals to date to either BDS or DEQ. In our meeting with DEQ on January 7, 2020, Parks committed to a specific timeline as justification for an extension of the PPA requirements, and it appears as though that is slipping without communication to either DEQ or BES (i.e. Brian Marcum), who was designated as the environmental professional for the project. The updated gantt chart provided to DEQ is pasted below for reference. In addition, as we discussed, progress on source control actions for this site are important for moving forward with various components of the Portland Harbor Superfund work. I’m wondering if you could please provide an update on your timeline for revised Land Use submittals for this site, or let us know how we might help facilitate forward progress in this work?

Hello Britta and Kyle,

In the meeting with DEQ on January 7th to discuss DEQ’s warning letter to Parks regarding non-compliance at the PGE/Forest Park entrance site, the timeline that was provided to DEQ indicated that updated design documents would be provided to the City’s land use review department by January 21st in order to keep the Forest Park entrance construction project on-track to comply with DEQ requirements. Parks also indicated they would share their updated submittal documents with DEQ concurrently to facilitate a coordinated review by the agencies. Can you please confirm whether these documents have been submitted?
