Dan,

I agree. He’s already called his attorney, and she’s already called me. I think you put the ball in his court, give him the approval document with the highlighted conditions that still need to be addressed and ask him how he intends to address them. Also, it is important to make sure that the building official has a copy of the decision with the highlighted conditions that haven’t been completed, and let him know that that information has been shared with the County.

I believe we should ask Jim Taylor how he would like to handle this issue. But we do that in writing. He can either finish the job completely and we move on, or, we move into the enforcement and revocation process. Once we do that he will call his attorney and try and stand at the counter for 3-hours and tell us why we are wrong. He just needs to get his work done.

Aldo,

Those are separate approvals from the land use approval. I would look for overlap between the unsatisfied condtions and any requirements of the other applications. Where there is overlap, the City can enforce the requirements as part of the pending (business/building) permit application approvals. For instance, the building code in particular may have several substantially similar requirements from which the language of those approval conditions were borrowed. To the extent that there is no such overlap for one or more approvals, the City would need to look to initiating enforcement and/or revocation of the original land use approval for non-compliance with enforceable conditions that were not appealed when they were imposed.
