Hi Scott,

Thanks. I understand from speaking with you briefly this morning that you are waiting for some additional information from Aldo to complete your report. As you and I discussed on the phone last week, in addition to an explanation of the applicable Code provisions requiring half-street improvements, the City also needs a metrics-based analysis in the record supporting the imposition of those requirements, which should be included in the Proportionality section of your memo.

In the Washington County memo previously forwarded to you by Gerald, there is a section that provides guidance for undertaking that analysis in order to support a condition requiring frontage improvements. Here is what that applicable language says:

Land use permitting staff at Washington County have developed their own method for evaluating the proportionality of frontage improvements. This method is frequently useful for evaluating the proportionality of half-street improvements required of infill developments and is essentially a modified application of the impact and exaction ratios descried above. County staff estimate the length of roadway impacted by a new development and multiply this length by the ultimate width of the roadway section to arrive at a square foot area for the entire street segment. Staff then estimate the square foot area of any half-street paving or sidewalk required of the developer and compare this value with the overall area of impacted street to arrive at a percentage of total street area to be improved. This percentage is compared to the percentage increase in vehicle traffic to ensure that they are ‘roughly proportional’ to one another. Insufficient data exists to define a point at which the percentage of street area improved becomes too great relative to the increased traffic and the exaction is no longer proportional. It is important to note that the percentage of roadway surface improved need not be less than the percentage increase in vehicle traffic, and many exactions in Washington County have been upheld despite the improved street area being proportionally larger than the increase in traffic.

This methodology may be the most straightforward way for you provide the necessary analysis, after you obtain the information you need from Aldo. Please don’t hesitate to call or email as you are adding that analysis to the memo.
