Hi Aldo,

So the applicant did not complete the ROW dedication or construction of the frontage improvements during the original construction of the building. After the building was constructed the City Manager required the dedication of the ROW in conformance with the code in place at that time. The condition to sign a waiver of remonstrance is in lieu of construction of the half street improvements which was also a code requirement at the time of construction. The waiver doe s not require the construction of the improvements but it does require the applicant to pay their fair share of the improvement cost when the roadway is constructed thru their site by another developer or the City of Molalla.

As you discussed with Dan, your narrative needs to speak to the compliance with the code at that time. The Planning Commission in its review can:

1. Deny the appeal and leave the condition as is; or

2. Approve the appeal and overturn the condition; or

3. Overturn the condition and replace it with a condition to construct the half street improvement in compliance with the original code.

I will not be at that meeting due to medical appointments but you should have enough to move this thru the Planning Commission. Thanks.
