Page 65 of the budget has our current CIP. There are no plans in the next 5 years or sooner to improve that roadway. The prior public works directors discussion regarding the Nazarene church had to do with full improvements at that intersection and completion of sidewalks along Shirley and Hwy 211 from Shirley southwest. That was a discussion about intersection widening and striping that would happen sometime in the future “if” the church came in with a development proposal but still does not affect or have impact to your development. Please convey to Stafford Development that they will be required to make frontage improvements along Hwy 211 along their project and that we are open to providing them with transportation SDC credits to complete the road and sidewalk to connect into the existing sidewalk on the north side of Shirley. I appreciate the feedback Gerald. For clarification when updating the applicant, I believe Jennifer mentioned at the Pre-Ap that the City has a current CIP line item to install sidewalks on Hwy. 211, including frontage along the Molalla Church of the Nazarene and the Shirley Street intersection. The applicant’s proposal to provide a fee-in-lieu was based on this information and the assumption that including frontage improvements to our site as part of this larger public project would be beneficial from a public safety standpoint. Could you let me know if we misinterpreted Jennifer’s project description? If not, could you me know if this planned project changes the City’s position on granting the fee-in-lieu request?

Hi Steve,
I spoke with Dan and we are not aware of any improvement by ODOT in that area. They may have a paving or chip seal project scheduled but would not widen and improve the roadway to include bike lanes and sidewalks. That is part of the conditions the City would apply to a new development to bring the entire frontage up to City standards in accordance with the TSP and PW standards. 19.04.210(C) is a mechanism Cities use when a planned roadway project is fronting a proposed development and is scheduled in the near future under their capital improvement plan. It allows the City, as an option, to have the developer pay a fee in lieu of improvements to cover their fair share of the frontage costs and the City will in turn use those funds in their project to make the improvements along the development frontage. We do not have a roadway widening project scheduled for this section of roadway so this provision of the code would not apply. We will require the improvements and the sidewalk ends can transition using an asphalt ramp approved by ODOT.
One of the things we could consider is and extension of the sidewalk and pavement improvement around the corner to connect in with Shirley St and the City would credit the developer on their Transportation SDC’s at the time home permits are taken out. We can do that as part of the Planning Commission process or by a development agreement. Planning Commission involves the least amount of paperwork and can be done during the design and construction process. Please let your client know if that is something they would be interested in and we can recommend that to the Planning Commission for approval. Thanks.

In my narrative, I addressed the reasons why we are requesting a deferral of the improvements under Section 18.16.020(O). The City,s mechanism for collecting a fee-in-lieu can be found under 19.04.210(C).
Besides the safety issues with a partial street improvement, it is reasonable to defer improvements on Hwy. 211 since a widening project is already planned for the area. By having the developer pay a fee-in-lieu, the City makes sure future homeowners aren't burdened by the frontage improvement costs. Let me know if you think this approach makes sense to you.

The frontage improvements are required by us and ODOT. We discussed in the pre-app that they would have to be done. Not sure where the fee in lieu came from. Only fee in lieu that I am aware of in the code has to do with Parks once you hit the pocket park threshold.
