He will not be requesting the fee-in-lieu, or a modification of any of the proposed conditions of approval this evening. Since the Planning Commission does not have authority to decide on our request for a fee-in-lieu it is not appropriate. Thanks for this clarification. However, the Planning Commission does not have authority to accept or deny a fee in lieu if there is a financial impact or responsibility to the City at a later date. I think Gerald was very clear as to our position regarding this particular matter. They make recommendations for applications that need to be decided by City Council, but we expected this subdivision approval to be decided at the Planning Commission level. We thought that tonight staff would provide its report to the Planning Commission with a recommendation and the Planning Commission would make the decision to approve, approve with conditions, or deny our application. Is that not correct? We had intended that our memo would provide more details on our request, and had hoped staff would take that under consideration and support our request. Staff will argue against this tonight.
