Hi Gerald,

 

In my narrative, I addressed the reasons why we are requesting a deferral of the improvements under Section 18.16.020(O). The City,s mechanism for collecting a fee-in-lieu can be found under 19.04.210(C).

 

Besides the safety issues with a partial street improvement, it is reasonable to defer improvements on Hwy. 211 since a widening project is already planned for the area. By having the developer pay a fee-in-lieu, the City makes sure future homeowners aren't burdened by the frontage improvement costs. Let me know if you think this approach makes sense to you.

The frontage improvements are required by us and ODOT. We discussed in the pre-app that they would have to be done. Not sure where the fee in lieu came from. Only fee in lieu that I am aware of in the code has to do with Parks once you hit the pocket park threshold.

In Dan’s staff report, he states that fee-in-lieu procedures for Hwy. 211 improvements will be determined by Public Works and ODOT staff. I did not see a reference to this in your conditions of approval. Can you clarify this item for me?
