Hi Spencer,

The point of intersection between the Ona Way right of way line and the ODOT right of way line requires a 12’ radius curve. They will also need to show the dedications that have been made as part of the bike and ped project so we can verify that the PUE and the ROW lines meet up with new dedication lines. I don’t care about the setback lines for what I have to review. It appears that they intend to dedicate on our forms and not on a replat?

I will need the following items in order to approve signatures on the attached warrantee deed:

  1. 1. Exhibit A legal description
  2. 2. Exhibit B map
  3. 3. Title report showing that they have not dedicated any access or other rights over the ROW parcel or parent parcel.
  4. 4. Letter from Stafford stating that they will not create or record any rights over the ROW parcel or parent parcel while this approval process is underway and recorded.

 

I don’t trust them at all and believe they would try to record something on the property that gives them access rights in the future before we can record the warrantee deed.

Also, we need confirmation that the taxes for the property are paid up for this deeded strip of land through conveyance. I don’t want a tax bill sent to us from the County for their failure to pay taxes. I’ve attached the word document if you need to strengthen any language. Thanks.

Per my conversation with Spencer yesterday afternoon, we are providing several drawings that show the existing lot line conditions, the lot line locations following the series of lot line adjustments we have proposed, and the final result after the Ona Way ROW is dedicated.

We will provide another drawing early next week that summarizes how we envision the lot line adjustments will proceed.

Please review the attached documents and let us know if you have any questions, comments, or suggestions before we submit the actual applications.
