Alice and Spencer,

Below is an email exchange between Mike Penunuri and myself. This is in relation to starting home construction in Phase 1 and building out homes beyond 30 in Phase 1. They had two accesses off of Hezzie Lane to cover Phase 1 but not enough for Phase 2 to begin. I met with Mike and Vince and they explained the fire requirement for the secondary access related to the diagonal distance measurement. The City offered MFR to the Fire Dept as a back up plan in case something happened out there during Phase 1 home construction such as a fire or medical emergency. I don’t remember any agreement on the part of the Fire Dept or us between either party and Stafford or LGI substituting MFR for Ona Way permanently. If so, we would have had to do a development agreement and change the conditions of approval that Nicholas wrote.

During that start-up of home construction, Stafford told the Fire Department and us that as soon as they sold Phases 1 and 2 they were immediately moving forward on Phase 3. Of course that didn’t happen but also I don’t have any follow-up documentation stating that home construction could continue past the 30 homes without the Ona Way connection. Stafford bailed on their obligations once home construction was allowed to proceed. In other words, they sold the development and walked away. With changes in staffing this simply fell through the cracks. Home approvals and lot construction continued with LGI into Phase 2 and Stafford abandoned follow through of Phase 3.

The really unfortunate part about this is that we’ve tightened our requirements for infrastructure improvements that now make it much harder for small developers to do business in Molalla. My discussions with Alice have included the idea of not signing off on future final plats and subdivisions until all improvements are done effectively taking away our ability to work with contractors and developers cooperatively.

Hi Mike,

They have two accesses into the development off of Hezzie Lane and an additional fire access with locking gate on to Molalla Forest Road. This is a phased development and the developer is looking at moving forward soon with phase 3 which will connect Ona Way stub south to Hwy 211 giving you 4 points of access. If you limit them to 30 houses when they have two roadways leading into the development and an additional access on Molalla Forest Road then I can’t support that. Big Meadow was built in phases and the FD did not limit them to 30 homes per phase, correct? I thought we decided this wasn’t an issue back in the Nicolas Lennartz days. Why the change in direction last minute that will put you at odds with the developer?
