Good afternoon Spencer:

Included in this email is the full compilation of regulatory tools that we believe Molalla Planning/PW, County Building Official and Molalla Fire Marshal can use to an use to not approve all remaining COs in Bear Creek Subdivision. Included in this email is:

  1. 1. Final Notice of Decision w/ my research highlights for your quick review. You’ll notice that this is the Ordinance approving the Zone Change. The approved Planning Commission findings and conditions for the PUD are included as an exhibit to the Zone Change Ordinance because the PUD was dependent on the Zone Change.

 

  1. 2. An infrastructure phasing plan submitted by the applicant two days before (dated 1/18/2016) the January 20, 2016 Planning Commission hearing approving the PUD. This phasing plan is referenced in the Notice of Decision.

 

  1. 3. MMC sections with enabling legislating, adopting the State Fire Code. We have also included the applicable sections of State Fire Code, requiring two access points or fire sprinklers for all developments exceeding 30 dwelling units.

 

  1. 4. MMC sections with enabling legislation, adopting the State Building Code. We have also included the applicable sections of State Building Code, enabling the Building Official to withhold COs for developments that pose a threat to health and safety.

 

It would be best if I had a chance to review these materials with you by phone and then jointly discuss next steps with you. We will want to bring Matt Rozzell and Mike Penunuri into the conversation after we have walked through these materials.
