Hi Julie,

The attached are files provided to PW from applicant with our comments showing the connects in Phase 3 of the master planned development and the conditions from ODOT.

The following are Public Works’ comments for the proposed development on Phase 3 of Stafford Development Co’s approval under Planning File P70-2015. The development was a master planned development which included all of the properties fronting OR 211. As part of that MP approval, Stafford was to provide a second access into the development via extension of Ona Way as part of Phase 3 and was also a compromise given by Molalla Fire for their secondary access requirements. Stafford Land was to begin work on Phase 3 once Phases 1 and 2 were completed and that never happened. The City also worked with ODOT to allow for Stafford to be part of the OR 211 Bike and Ped project to construct the frontage improvements and point of access for the Ona Way extension and then Stafford backed out of the modification to the federal project.

As part of the application, the City ran the Phase 1, Phase 2, PUD, and Rezoning concurrently at the request of the applicant. All public notice requirements were met and the Planning Commission met on the rezoning on 11/18/15 and PUD on 01/20/16. Under Goal 10 findings, the higher density use would supply needed housing for multi-family, group homes, and adult care facilities. Under Goal 11 findings, the properties would support a more efficient use of transportation facilities including the secondary connection via Ona Way extension. Under Goal 12 findings, full buildout would increase cross-connectivity and that the proposed and existing zoning designations would require extension of transportation facilities. Additional justifications were provided in findings under Housing Policies.

In Planning Commission Findings Part 1 Number 3, a decision to place proper conditions on future development for each area is provided.

In Part 2, Planning Commission found that the frontage parcel on W Main Street recommended facilitating public transit ridership. On Page 11 of the findings it states, “The newest site plan provides that the intersection with Ona Way and W. Main St./211 will be provided after Phase 1 but before Phase 2. The addendum to the traffic study found that the intersection of Hezzie and W. Main St./211 could control the function of the intersection after full build-out of phase 1 and 2 of the subdivision. Regardless of this fact, the applicant is proposing to make that street connection as a right-in/right-out access for this development. Acceptance of that traffic design will be contingent upon approval by ODOT and the Public Works Director." This connection was never pursued by the applicant and based on the findings, Public Works has found the applicant not in compliance with the original approval and no activity to resolve in a proposed Phase 3 to develop the entire frontage has been submitted at this time. On Page 15, the applicant had no exceptions to the access and circulation standards. On Page 16, the ROW acreage is listed as 0.21 acres. Per the findings on Page 21, that area is consistent with the review of materials initially submitted to Planning. Additional Transit related finding regarding the parcel on OR 211 are found on Page 24. Applicant is required to coordinate with SCTD for improvements.

In order for any land use, development, or redevelopment of the parcels to occur, the applicant shall first comply with the above requirements related to dedication and construction of connection of Ona Way and further identified Decision 7.iv.n. on Page 29 of the decision. Additional consideration should be given to the requirement to construct frontage improvements as identified on the 2nd page of the ODOT response.
