Both parties involved with the non-permitted fill said they got the soil from LGI Homes. I called Isaac, of LGI, this morning and told him to stop moving soil next door. He wasn’t aware that his subs were doing this but will direct them to stop.

Hi Brenda,
If it is property with a drainageway or noted wetland on our wetland inventory then before any fill can happen they need to complete the wetland delineation, get DSL concurrence, submit a fill/removal permit and get approval (if necessary), and a grading permit from City/County.
If it is property without a drainageway or noted wetland on our wetland inventory then before any fill can happen they need a grading permit from City/County. Need to make sure they are not impacting utilities or overland flow drainage issues for other properties.
That is the process moving forward for all properties that want to do this kind of stuff. Thanks.

I appreciate the clear direction on this. Secondly, the house next door to this one – 931 W Main has added 4 loads of dirt by the wetland. This is about 40 CY so I would like direction on this since it is under the 50 CY needed for a permit does this fly under the radar or since it is next to the wet land would it still be regulated? I was thinking he could move this 50 feet away from the wetland and then he may not need a permit. He wants to fill in some depressions on his property to he can mow easier.

They will need to submit a concurrence of the wetland delineation, plan approval possibly with DSL, a grading permit with the County or City, and before the fill can take place the wetland needs to be staked in the field with lathe so that the contractor knows where they can and cannot go. We will need sign-off at the end from the permit issuers before we can close the books on it. Thanks.

Gerald,
On the issue of filling in around a wet land on this site I have spoken with the new owner (Martinez) and she said that they are in the process of getting a wetland delineation report and expect it any day. They have added approximately 300 CY of soil to this site around the drainage ditch. I asked the owners to cover the piles with some straw while we figure out a plan of action and told them this is not allowed without permits.
If they get the wet land delineation report I’m not sure of the approval process for this type of work. I’m assuming that we need the report first then they would need a site plan and then they would need a grading permit from DSL? Please advise.
