Hi Gerald and Dan,

Dr. Orr and the Dowl consulting team are still waiting to decide about their next steps. I am inclined to issue the decision anyway. We know the requirements and the longer we wait, the more time we consume with the 120-day clock.

The 120-day deadline has been extended only to 10/21/2019.

I ran everything through my “handy-dandy 120-day clock spreadsheet”. If we issue the decision today….and it gets appealed to PC and CC, we will be just barely be finished by 10/21/19….We would make it to the 10/16/19 CC meeting.

Are you okay with me issuing the decision now? If we wait, I’m not sure what we would be waiting for.

Hi Alice and Gerald,

I just spoke with Dr. Orr regarding the Partition application. He’s trying to determine the cost of the required improvements to determine whether or not he is able to go through with the application. It doesn’t look like our office will be able to put together a price estimate until next week, so I wanted to let you know we likely won’t have a response until then.

Gerald, I have a question on the required improvements.

On page 8 of the Staff Report, Condition H.ii. it says:

ii. Construct the half width improvements on the south side of West Lane and into the intersection of N Hezzie Lane a. Road improvements will be constructed to City standards for 20 feet of pavement (face of curb to edge of pavement), 2-foot wide gravel shoulder on north side, curb and gutter, 6-foot curb tight sidewalk and street lighting on the south side from N Hezzie Lane to the east limits of the partition boundary. Intersection improvements will include ADA accessible sidewalk ramps per City standards. Additional signing and or modification will comply with City requirements. The City may elect to have the Applicant construct the full pavement width, curb and gutter, and sidewalk on the north side of N Hezzie Lane and credit the Applicant utilizing System Development Charge credits for Lot 3. The balance of unused SDC’s will be credited to the Applicant. The balance of SDC’s owed will be paid to the City at time of building permit for Lot 3.

Regarding the highlighted sentence, I believe you said during the phone call that this additional improvement would not be required, since the City does not have the budget for that improvement at this time. Can you please confirm that improvements on Hezzie Lane north of the site will not be required with this application?
