Good morning,

Dr. Orr has officially requested a 30-day extension to the 120-day time limit for this partition (see attached). He is requesting this so the City will delay issuing our Notice of Decision on the Partition. The delay will allow him time to discuss the possibility of delaying the installation of half street improvements for the east side of Hezzie and for the south side of West Lane. We were ready to issue the decision yesterday. As a courtesy, I allowed them to see the staff report with findings and conditions we prepared in support of the partition. Upon seeing the requirement, the applicant’s consultant said Dr. Orr will want to meet with Gerald to see if the City Engineer is willing to offer any flexibility in the timing of the transportation improvements, under this provision of the code below (17-3.6.020.A.5).

Note to Gerald: I spoke with Dan about this in your absence. We fully expect the City to deny this request, in recognition of previous delay granted when the development agreement when was recorded on this property. That said, the Code allows the applicant to request you to allow deferral of the street improvements. The time extension will allow him time to make that ask. I have suggested that the applicant contact Christie to set up a meeting with Gerald before he returns. Christie: You may hear from Kaitlin Berger of the consulting firm – Dowl.

We would like to request a 30 day extension to the 120 day calendar, that way we will have an opportunity to discuss the frontage improvements requirement with the Public Works Director and the property owner before the notice is sent out.
