So if I'm understanding you correctly this lot is held to a different standard than the other 40 lots built along this creek/wetland? Have the other builders/home owners also had to provide you with this information and out of pocket cost? I know builders in the area that have built well within the 50' setback and never been asked to provide any information nor had out of pocket cost to prove differently! Can you please let me know what's different about this lot?

There may be something we can authorize as the property was created before the water resources overlay zone was implemented, but either way we’d need to determine what the actual location of the riparian area is on the property. Nothing on the plat that I saw lead me to believe that the property line itself was the riparian boundary. The plat dedicated tract J to the HOA, called it a ‘shared wetland’ and restricted access to only an easement. If Mr. Bystrom has other documentation besides what I have access to via PlanMap then I am happy to take a look.

What we know for sure is that this property lies mostly within the riparian corridor, but we don’t know to what extent. If you were to submit to build on the property, we would need a site plan that shows the location of these boundaries:

18.28.040 Site plan required.

When a use or activity that requires the issuance of a building permit or approval of a land use application is proposed on a parcel within, or partially within the WR Overlay District, the property owner shall submit a scaled site plan to the City that that shows the precise location of:

A. Topography;

B. The stream top-of-bank;

C. The 100-year flood elevation;

D. The delineated wetland boundary with documentation of concurrence by the Oregon Division of State Lands;

E. The required riparian setback;

F. Existing vegetative cover and type; and

G. Existing and proposed site improvements. (Ord. 2010-15 §1; Ord. 2010-04 §1)

 

My recommendation would be to hire a wetland delineation expert, if you are serious about pursuing the property for purchase.

Nicolas,

Talking today with Mr.Bystrom (the current property owner) he has told me this was surveyed and the property line is the setback? Reading the information you sent me yesterday has me confused to say the least. The residence on the corner of Mary and Anne (lot 106) in tract D is in no way setback the 50’. Can you please tell me the difference between tract D and J?

I am not comfortable accessing this with my naked eye and running into issues further along and finding out a lot we’ve purchased isn’t buildable. Any help would be greatly appreciated.

It is the applicant’s job to demonstrate compliance, so I would need to tell from your application whether or not the proposed home encroaches on the WR overlay district. It would be measured from the upper edge of the ‘bank’. I’m not a biologist, but a certified wetland surveyor would be able to tell where that bank edge is, usually it’s actually quite easy to tell with the naked eye where the bank is, too.

Basically it prohibits development within this boundary. We would need to determine exactly where on the property this line is before authorizing development. Typically that is performed by a wetland expert or environmental consultant.
