Good morning,

I realized this morning that I have not yet distributed materials for our pre-app meeting at 3:00 p.m. tomorrow in the City Hall Conference Room.

We did discuss this pre-app last week. Several years ago this property owner (Brian Mills) opened a home security business in a former residence at 723 W. Main Street. He didn’t obtain a business license or permits to make his property legal as a business, such as paved parking or ADA access improvements to the building.

Through an unfortunate mistake, he was able to obtain plumbing and electrical permits from Clackamas County. At that time, Clackamas County was not doing the best job coordinating permit review with us. Therefore, the City didn’t have a chance to weigh in on those permits regarding business occupancy at the time.

In 2017, Mr. Mills proposed to build a “shop” building in the rear of the existing house. Due to the heavy requirements, the applicant abandoned that plan. I have attached that approval document, PW comments and ODOT’s comments for P33-2017.

Now, Mr. Mills wants to expand his business to sell firearms. The only reason we learned of this is that he had to apply for a permit from the Feds – ATF (Alcohol, Tobacco, and Permits). The permit form requires a sign-off from the City. Mr. Mills was hoping we would sign off on the form very informally. We told him that he still has not established a legal business location on the exterior of his property (paved parking, paved driveways ADA access/parking, etc). He was argumentative about needing to do anything more to his property, but we were successful in telling him he needs to schedule this pre-app meeting.

As you can see, Mr. Mills scratched together some proposed plans. I don’t expect him to be a willing participant on Wednesday afternoon. That said, he does want to sell firearms at his property and may be motivated to comply.
