Hi Sam,

Thanks for the follow up. I am waiting for a response from DSL regarding any required setbacks / buffers from the creek. Depending on their answer, we will make a decision on our approach to addressing the storm water requirements. I tend to be leaning to either a drywell or on-site treatment & detention discharging to the creek. I will ask my client to look into acquiring an easement. Appreciate your advice.

Hello Mark,

All discharges shall comply with the Molalla Public Works Standards Section 3 and its NPDES permit issued by the DEQ, per 13.13.250. Where a public storm sewer is not available the building storm sewer shall be connected to a private storm system that meets all federal and state rules, and does not impact groundwater, drainageways, or downstream properties, per 13.13.280. Depending on whether Creamery Creek is located on the property or adjacent to the property north, A private easement maybe required. One other option could be a drywell located on the property.

Hi Mark,

We do not require pre-apps for SFR builds. That said, this property has some unique challenges due to its proximity to Creamery Creek. The short of it is that I’m not sure how much of that property is buildable and whether that balance meets density standards for the R2 zone. If it doesn’t we would have to look into either a variance or whether it would be possible to build in the footprint of the existing structure, per 17-2.4.030,2, a.

Given these potential constraints, I would strongly advise to at least fully determine the top of bank (so you can determine the buffer) and fill out a due diligence inquiry prior to building permit submission to address the general question of whether the lot is buildable without a variance. It may be worthwhile to reach out to DSL directly as well to ensure that the existing structure would qualify for replacement.

Hi Dan,

I have a client that would like to construct a home at this address. All utilities are in except for storm water which we can either pump to a weep hole or treat on site.

Just a quick question…. Do we need to go through a pre-app as part of his building permit process? I have a copy of the building permit application and checklist and I see that a site plan is required to be submitted with our application. Should we construct an infiltration basin on site, what kind of information do you require? If you would confirm for me, I will inform my client.
