Based on the aerial and road view it appears that Lot 1 has filled in the required detention pond for the development. I verified that Plat 3472 shows Note C as being a storm drainage easement 56 feet into Lot 1. The pond must be restored to its original condition. Option 2: As an alternative, if you want to keep the landscaped area then the City will consider a designed and constructed detention/water quality swale along the parking area fronting his property as long as it contains the same volume and fits within the parking strip. You will have to do a curb extension with ADA ramp that guides folks around the corner and the swale will have curb completely around the swale to protect motorists and pedestrians. If that is done then the City will quit claim the easement on your property. This will require engineered plans.
