Hi Paul,

That development was brought in under a master planned development and is considered shopping center. Since the open spaces are already paid for, if under Planning’s approvals that is an allowed use in that area then there would not be any SDC’s for that site as it is already covered. Thanks.

Aldo – Can you let him know if that is an approved use? Thanks.

Thank you very much for tracking down this information for us, and even looking into possible exemptions.

I appreciate the time you took explaining details during our meeting. I was hoping you could clarify one more thing.

During our meeting someone suggested some other properties which are zoned commercial, such as the Safeway complex.

Would SDCs apply to buildings already in the commercially zoned properties? Is trip generation still a factor?

Specifically, I'm wondering about a vacant space in the Safeway complex. It's 2000 square feet and addressed as 1515 W Main st Suite Q, Molalla.

Would you be able to tell me what, if any, SDCs might apply there and how much they might be?

Hi Lisa,

I looked at the existing service and the change to the new use. If the site was done today under General Light Industrial then the SDC's for 2,500 SF would be $10,007. The category you business is under is Health & Fitness which is less than a club style facility with lifting equipment, treadmill, etc. The comparable cost for Health & Fitness is $36,412. Since the building currently exists then we would deduct the General Light Industrial from your new use which totals an SDC of $26,405.

I looked in our code under exemptions and here is what it says.

13.14.100 Exemptions.

A. Structures and uses established and existing on or before the effective date of the ordinance codified in this chapter are exempt from a system development charge, to the extent that such structures and uses are not altered, added to, replaced, or changed in use so as to increase demands on any capital improvement for which systems development charges are imposed.

B. Additions to single-family dwellings that do not constitute the addition of a dwelling unit, as defined by the State Uniform Building Code, are exempt from all portions of the system development charge.

C. An alteration, addition, replacement or change in use that does not increase the parcel’s or structure’s use of the capital improvement facility is exempt from all portions of the system development charge.

D. A project financed by City revenues is exempt from all portions of the system development charge. (Ord. 1999-14 §1; Ord. 1991-6 §1)

Because the use increases the traffic generation (trips) to the site it unfortunately does not fall under one of the exempt categories. Sorry I didn’t have better news on the SDC costs.
