This hereby confirms our receipt of the withdrawal. We will remove this item from the agenda for the February 5 Planning Commission meeting. We didn’t have a chance to meet with you in a pre-application setting prior to your submission of the application. If you intend to submit the proposal again, we advise having a pre-app meeting. The fee for this meeting is $55. I have included a link to the pre-app form. If you wish -- at this pre-application meeting -- we can discuss other MMC violations present on adjacent Avison properties. In speaking with the city attorney, we understand that this means the matter will be removed form the planning commission’s agenda. Please advise right away if this is mistaken. We intend to resubmit that application after we have had a larger discussion with the city about concerns that we understand it to have that appear to transcend the night watchman application and seem to be affecting other matters. I have reviewed the city code and see no provisions about withdrawal. If I am mistaken please let me know to include if you require something more formal from me toward that end. This is to request a meeting with you, the city attorney and whomever else in the city is appropriate and Bill Avison and myself to discuss the city’s larger concerns. Please let me know your availability to participate in such a meeting. Thank you. Best, Wendie Wendie L. Kellington|Attorney at Law. P.O.
