Dan,

Spencer has failed to make anything happen on this. They still have not taken out a permit to install the cleanout. I think that option has passed and we should go back to permit for cleanout and SDC charges. They’ve failed to hold up their end of the bargain and I think we should fire our City Attorney from this one and turn it over to Mac. I’ve not heard anything on this since August.

Mac – thoughts?

Spencer – I am thinking that maybe we need to tell Mike Robinson that most of the issues identified will not work for us. I am not going to argue over these items that are non-starters. We acted in good faith and this looks like something written by Beau Ellis for a precedent setting process for Avison in the future. Sorry for the vent.
