Hi Marcela,

Thanks to both you and Loretta for the responses. Gerald and I expect we will have pre-app meetings in the future on one or more tenant changes (or changes in use). All of the tenants on the sites have changed since 2014 – and none have been legally established through a City of Molalla or ODOT process. At least one of the uses will result in more trip generation – from a freight/warehousing/distribution ITE generation category to a light manufacturing ITE category. We will have more details in the near future – and be sure to include ODOT in any pre-app meetings.

In the meantime, we wanted to know if any access permits were current on the site. You have answered that there are none at this time, besides those established through the “Presumed to be Permitted” ORS.

Alice,

ODOT requires that all highway approaches have a written permit (ORS 374.305.) The district maintenance office that maintains the written highway permits for this section of the highway was unable to locate a written permit for the two driveway on OR 211 that Tax Lots 7800, 7700, 7600,9200,9100, 9300 are using. This is not uncommon, and therefore when ODOT’s regulations were modified in 2012, a rule was added that addresses this problem: OAR 734-051-3015(2) provides that a state highway connection that was in existence on January 1, 2014, is presumed to have the department’s written permission if the connection was built or rebuilt to the abutting property with the department’s knowledge or permission. Reviewing google maps these driveways existed on January 1, 2014 and therefore we are considering their status as Presumed to be Permitted. The presumed use is the use of the property on January 1, 2014.

All that said, with any land use we will require the applicant to obtain a written permit with the district. This section of OR 211 is a district facility with a posted speed of 35 mph, and our spacing standard is 350 mph. During the land use, we will be making recommendation to ensure that our access management goals are met for this section of the highway.

do you have more details about what they are planning to do? Changing owners will not trigger our change of use criteria. As Loretta mentions, we will need to know more about the proposal to review the change of use criteria.

What does it mean when you say, “presumed to be permitted?” If a new company occupies one of the existing warehouses will that company need a new access permit? I assume your answer is yes. We will likely require a Traffic Impact Analysis for this new use.

I wasn’t sure who should receive this question/request. We are researching development approvals on some addresses in Molalla and wanted to know if any of these properties have current, approved ODOT access permits. The addresses are located along OR-211:

If you find current, approved ODOT access permits on these properties, can you either send us a copies of the permits or identify the addresses and a brief summary of the type of use/access approved (and associated conditions) for each address?

We appreciate your help. This property owner is contending that the site has many “grandfathered” approvals. We suspect that many of the current uses were not established legally.

Let us know if you have any questions. Also, if I can look up this information myself using an online tool, just send me the link. I am happy to research this myself.
