Attached is a copy of an email Bethany Harris of Scandia USA sent to her supervisors as a result of a meeting she attended with you and other members of Molalla City staff on October 31, 2019.

 

It's my understanding the meeting resulted (at your request) after reviewing Scandia's business license application a couple of weeks prior. Also, it appears Ms. Harris was told multiple times during the meeting that a business license would NOT be issued until the items identified on the email were addressed to your satisfaction. It should be noted that Scandia is a Tenant (not the owner) and is only leasing the property in question. In the Landlord's review of the list, it's clear nothing contained therein is the responsibility of a prospective tenant, nor applicable to Scandia's specific business operation which complies with your code requirements in the M2 zone. And as important, it doesn't appear Molalla's code allows for the rejection of a business license for concerns that DO NOT specifically apply to the applicant (in this case the Tenant).

 

Mike Rogers (Director of Operations for Scandia USA) has made a special trip from their East Coast headquarters to address this situation. He will be in Molalla Wednesday and Thursday and would like to meet with you and members of staff that participated in the meeting. I'll be in attendance as well and we'll make ourselves available to meet anytime Wednesday after 10:30am or Thursday until 5pm. This is an important issue needing immediate attention. 1. Dust issues need paving done all the way to the street

 

2. Need storm water and water quality tests

 

3. Water line is like Swiss cheese and will need to be replaced from our building to Main Street

 

4. Need a field permit from the department of land

 

5. Need wetland scientist to test the ponds and a letter of concurrence Protected land by state of Oregon

 

6. We need a code site design review

 

7. There is a public hearing process

 

8. Need Rainier off the property. They cannot operate out of a tent and they were dumping raw sewage out of their campers into the ground next to our building. They also have no business license and are operating illegally.

 

9. They said to hire a planning engineering firm

12. They do not allow a permanent construction trailer we will have to remodel the existing office.

 

13. It will take 4-5 months to get this approval process and hearing complete and WE ARE NOT ALLOWED TO OPERATE our business until this is complete.

 

14. We need a pre application meeting with AKS and the city

 

15. We have to have DEQ also test the ponds for contamination

 

 

They said sorry to be a bearer of bad news and they do want us here but there is a lot of expense involved.
