….phone call with Chris Crean from BEH. Spencer wasn’t available. Chris cut right through all the confusion.
In his view, none of the prior uses were legally established, so we don’t have a nonconforming use situation. Also, the former mill site has long been discontinued, so all new development must comply with our code.
What is “new development?” Is it new development, if a new use is planning to occupying a nonconforming development? The answer to that is found in the Site Design Review section (17-4.2.020). In this case, if the change in occupancy results in an increase in vehicular traffic or development, then Site Design is triggered. Site Design Review then requires compliance with most or all of our development code.
