Yes that is definitely a trip hazard. If the city can require that they fix that then all I need is a miscellaneous permit applied for from the property owner or their contractor.

Loretta,
Tootie is planning on partitioning her property. The ODOT sidewalks along her frontage on Hwy 211 are currently displaced – there are at least 2 panels that are heaved up almost an inch – the curb looks old too. The city can require a developer to bring their public works up to current standards when they partition. I would like ODOT to look at this section of sidewalk and let me know what needs to be done. I attached a few photos. Thanks.

Hello Marlene,
Thank you for your willingness to look at my proposal. I am seeking to partition a 9600 sq ft lot from a larger parcel of land I own at 524 E Main Street, Molalla. The property is currently being used as Prairie House Inn and zoned R-2 and will remain so. The property in question is just under one acre. The remaining acreage -- about 29000 sq ft -- will be sold to a builder for construction of homes or apartments.
I have already drawn up a plan which I submitted and have received approval pending improvements to sidewalks which includes consultation with ODOT, additional 4 space parking in front and conformity with current public works standards, which I believe I have.
The city has also requested that the engineering firm read and comply with City Municipal Code 19.12.110, which can be found online.
Please see attached map for more information which is a partition that was accepted by the City of Molalla subject to conditions.
