Tootie,

We have addressed this PUE Easement at 2nd St per updated drawings. See attached. I worked out details with Brenda Reiner, Senior Engineering Technician City of Molalla, since Gerald is on vacation this week.

Correct that Lot 5 Moody Station covered about 2.6 feet of the requested 10-foot PUE. The remaining approx 7.4 feet is your property and detailed on the Plat now.

This updated drawing also included the changed for Access on drawing and notes restrictions on Sheet 2 Plat Notes #7 & #8.

I sent all of this to Aldo when I got home last night and sorry I forgot to include you.

I think all we almost ready to go final.

Needing:

  1. 1. Final City Approval
  2. 2. Access Maintenance Agreement
  3. 3. Print on mylar
  4. 4. Get your notarized signatures
  5. 5. Get Cities signatures
  6. 6. Turn into County Survey for County signatures and final recording

 

FYI my family is taking a short vacation from Sat 7/21 through Wed 7/25. I will be back to work Thursday 7/26 probably playing a lot of catch up.

That condition was satisfied with the recording of the original recording of lot 5 with Clackamas County in 2005. Its in the clounty's report.

Question. How do we address the 10-foot Utility Easement parallel to E 2nd Street when a portion of this is on Lot 5? Are we now required to get Lot 5 owner to provide a portion of this Utility Easement?

Basically making sure easements are recorded and following ODOT conditions. I’ll be send you the approval by the end of the day with the all the conditions. I attached Gerald’s conditions for you see. The other conditions are planning, which are fairly simple. You need remember that this was a new application, so conditions are attached.

The notice that was sent to the landowners was the notice of application. This gives an opportunity for anyone interested the application to comment and request a notice of decision. Since no one commented on the application notice, that means only you will receive a notice of decision. Technically you could also appeal our decision.

To answer your question, no the 14 day appeal period has not been satisfied yet. But like I mentioned previously, it will not get appealed unless you want it to be appealed. So once I issue the decision (hopefully today) Tony can start working on the conditions during the 14 days appeal period and update the plat – so once the 14 days are up, we can have a ready to go Plat to sign and send off to the county for recording.

I will try and finish the report today. There is a 14 day appeal period that comes with the decision. The good thing is that no one commented, so you will be the only one who gets the decision.
