Gerald, the normal way to approach this would be to require them to have a Pre-Treatment Permit from the City that specifies no discharges to the sanitary sewer other than domestic office/bathroom runoff. The Permit should require reporting of any discharge other than that (which would constitute a violation of the permit. We should also ensure there is some kind of manhole or cleanout that can be used to point source test their discharge at any time we feel it’s necessary. As a side note, our NPDES permit says that if we establish a Pre-treatment program like this, it will automatically move our treatment plant from a “minor facility” designation to a “major facility”, as specified in the permit, along with associated new fees, costs, and DEQ oversight. That includes the renewal application we currently have open with DEQ.

Hi Alice,
The short of this is that it is a chemical process that our sewer system can not handle nor can the plastic pipes our system is made up with. They will be required to do pretreatment, will be strictly monitored, all costs for this will be on them, and any violation will result in fines and potential shutdown of business. Because the have VOC’s they will also have to demonstrate that they have and will constantly comply with DEQ Air Quality along with no odors coming from the site and drifting into surrounding properties. This is out 10K foot look at it. I am open to talking with them about their process but they will not be allowed to discharge chemicals into our sewer system. Not negotiable.
