Hi Tony,

Based on what you attached, we just need a private easement across 2 for the benefit of 3. Parcel 1 already has a storm easement across 2 and infrastructure in place. If we assume a storm line for Parcel 3 is installed along the south end of Parcel 1 and 2 that can connect to Christopher Street right of way then drainage will be available for Parcel 3 without discharging on to properties to the south of the platted area. This can always be revised by redevelopment of parcel 2 in the future to accommodate the needs of Parcel 1 and 3. Hope that made sense.

Sorry I am a bit confused here on what you say and what the attached documents says.

1 F – Provide private Storm drainage easement along south line of Parcel 1 benefiting Parcel 3. Makes sense and acceptable

1 G – Provide a private storm drainage easement on the plat across south half of Parcel 2 for the benefit of Parcel 3. Not finding this reasonable or acceptable. We could accept “along south line of Parcel 2 benefiting Parcel 1 & 3”. This would be in line with 1 F and like what you note below.

In condition 1.D, I stated an easement along the south property line. This could be a 10’, 15’ or 20’ wide storm easement that will convey storm runoff from the properties to the storm system on Christopher Street and not drain on to the properties to the south. They will need to decide what is appropriate for their needs so that a private storm line can be installed.

We are finally getting time to address and review your comments then ideally get a review copy of Partition Plat out to City and County Survey.

In review I have a question about Conditions item G. It appears you want a blank Storm Easement on the south half of new West Parcel 2 (we are probably going to renumbering Parcels to be in order from left to right or West to East). Wow this really limits what could possible be done with this lot when it has such a broad easement across it. That does not seem reasonable or fair.

The school district has talked about options and worst-case scenario is they must consider selling this West parcel. Thoughts were for residential development so the school district can get money to fund other options that are hard to get funded. At 0.84 acres and I believe minimum lot sizes of 5000 sq ft there is the potential for 6 lots here. Course there are a group of existing storm and sanitary across the middle of Parcel that will cause issues already.

So any change of getting this reduced.
