Hi Steven,

 

Any new application will be required to meet current standards for stormwater detention and water quality. The facility designed and constructed was not designed or constructed to take on water detention needed for the properties in that area and I don't believe that the standards for existing development in that area met City requirements. I am not sure what the prior City Planner or PW Director did or may have agreed to back then, but it doesn't carry forward to today's standards.

I was doing some house cleaning this weekend and came across this information. I enclosed a few sheets of the staff approval letter we received. You should have the whole document on file there.

As we discussed but had to paperwork, this shows that we are to discharge in the cities newly created facility that is adequate for the development.

Hi Steve,

We could not find anything definitive regarding onsite detention requirements from the original development. I have discussed with the City Manager and recommended that we only hold you to detention/retention/water quality requirements under our current standards for your proposed expansion of your site and he has agreed.

So, for your new development our conditions of approval will reflect those standards for this expansion of your site and not retroactively for the existing facility. This condition will only apply to your current application and future applications may be under different standards based on other factors such as water quality and detention requirements dictated by the state or federal government in the future. In other words, if rules for us change in the future it will affect all development in the community regardless of prior conditions.

I would like to go over the items on the staff report from Shane Potter regarding our facility using the storm detention ponds provided by the city for exchange of land and bringing 2 business to Molalla to make this development even happen.

See these sections from the Staff report I received from Shane Potter.

Page 11, Item 3

1. Drainage Plan.

A drainage plan is shown as required by the Public Works Director to collect into a storm system in the newly proposed street.

Our plans showed our storm water going into the street storm system and was required by the Public Works Director. Plan was approved by city.

Page 24, Item F2

Storm Water: Storm water detention will be collected on site and sent to a collection system that will be built in the newly created road. This storm will be collected in a storm detention system that will be adequate for this development.

We collect the storm water through gutters and grates and send them to the collection system that was built. Plan was approved by the city.

Page 28, Item G

Storm water detention shall be created by the City as part of the new road system being created by this application. The applicant shall meet storm detention requirements as required by the Director of Public Works for site discharge in the City system.

We built the place and got occupancy, so what we did with going into the street and not having a pond on site was approved.

Hi Steve,

I found a conceptual stormwater management plan done by Parati for the 4 Corners Industrial Park which your property was part of during that study. The total stormwater basin requirements for the properties between Commercial Parkway and Molalla Forest Road totals 0.8 Acres. The conditions for this development states the following:

Stormwater: Storm water detention will be collected on site and sent to a collection system that will be built in the newly created road. This storm will collected in a storm detention system that will be adequate for this development.

This condition discusses detention onsite within the property and then conveyed to the collection system built as part of the Commercial Parkway roadway project. It appears that the detention facility was only built for the roadway and not for the two facilities along this roadway. Unless you can provide us with documentation through an agreement with the City that the City would be responsible for the development of a detention facility for a private property, I am stuck with implementing the code and standards as they exist today. Any development that goes thru a design review process will be required to meet today’s standards for stormwater detention onsite. Let me know if you have any documentation to the contrary and send it to me so I can review with Planning and Administration. I will keep looking on my end.
