However, I did get a call back from Martha from Planning and she said that they would have nothing to do with the planning since it is Molalla and my previously attached approval from Molalla's Planning Department is what I needed. I picked up the permit on Friday and later noticed that you had a comment in red on the front page that says "No occupancy under this permit. Future tenant to obtain separate building permit and certificate of occupancy." Can you elaborate on this? Part of the point of this permit was to get the Business Occupancy so my client's future office tenant could move in. I asked Dan at the City of Molalla and he didn't understand the comment either. He assumed this permit was for occupancy as well.

Hi Robert,

 

Thank you for the comment. The existing building is generally accessible. However, the back emergency exit pathway to a safe dispersal area is not. Since this Back Patio, Accessible Pathway, and Safe Dispersal Area are part of the new scope as shown on A1.0, I'm planning to use the "25% rule". How would you like me to document that rule? Would you like a price quote from my contractor for the work, or would a statement under the Description of Work on the A1.0 sheet suffice?

The project referenced above is being reviewed for compliance with the 2014 Oregon Structural Specialty Code (OSSC), and the following item was identified which must be addressed:

 

 

• Please verify that the existing building (including door hardware/thresholds, existing breakroom sink and work surface heights, and the existing restroom) are 100% compliant with current accessibility requirements… or alternatively: Please demonstrate how the requirements of OSSC Section 3411.7, Exception #1 (aka “25% rule”, in accordance with Statewide Statutory Interpretation No. 14-01 and ORS 447.241) will be met. [OSSC Sections 107.2.1, 202, 1103.1, 3411.4, 3411.7]
