106 Leroy was not annexed into the City but it isn’t a legal address. 106 Leroy is actually part of 110 Leroy – which was annexed in Sept of 2017. It’s confusing but it looks like there was a shop at 110 Leroy and then a house on the same lot but it ended up with the address 106 Leroy.

It does only for the properties that were annexed into the City. If 107 was already in then the code applies. If it was an annexed property then that was a deal the Council approved to give folks time to connect. Let me know if it was an annexed property or not then we can go from there. Thanks.

The Code Section 13.08.270 says that they need to connect provided that the public sewer is within 100 feet of the property line – it doesn’t mention the lateral. I guess the letter contradicts the code.

Hi Brenda,

Per the 2009 Leroy Ave project there is a SS lateral to this site on the south side of the driveway. It is important to note that in the 2014 letter to residents that the City can require hook-up within the 5 year time frame ONLY IF service is available. The definition states that, “Available service is defined as water and sewer service to the property owner’s property line.” In this case, there is a service to the property line so the property owner must connect within the 5 year period, pay the hook up fees and the SDC’s.

If it were a property that did not have a service lateral to the property line then we can’t force the connection of the annexed properties unless they 1) have a septic system failure, 2) the City installs a lateral to the property line, or 3) the owner develops or redevelops the property. So, you will need to hold off on the letter until we determine who does and does not have a lateral to their property line. Once we know who does have a lateral then we need to redraft the letter to inform them that there is one year left to connect and the expiration date on the grace period is July 23, 2019. After that it will become an enforcement action and we will have to notify them in a second letter to correct or face enforcement.

I’ve included others that will ultimately be in the loop when they come in to connect.

Put together a letter that informs the property owners and site the code requirements that states they have to connect. You may also want to get with Aldo and look at what Nicolas Lennartz sent out prior to my arrival. He was trying to clean that up based on some code language requirements. Gerald,

Finance notified me that they shut off water at 106 Leroy and also discovered that they have a sewer stub out but they are not connected. There are 3 houses on Leroy next to each other which are not on sewer – 106, 108, and 109 Leroy.

It seems like a good time to ask these houses to connect as they are by the wetland and on small lots and I would like to pursue this. What say you?
