Hi Gerald … I did stop by office today / Friday June 15th (and as you are out of the office the utility department is wanting to wait until you have reviewed before they respond to the ServiceLink escrow request concerning billings, liens, etc.) — and it appears that Buyer will want to WAIT until we get some idea of what additional charges/$$ will be after they purchase.

 

Buyer is aware of the C-1 zoning .. does not intend to use as residential … however, it seems there could be some SDC charges (?), and no one was sure what the fees for connecting to sewer would be for C-1 vs R-1 structure, etc.

 

The “unhappy” information from my perspective .. is that someone is willing to invest / improve a property in Molalla … and because of the foreclosure, ownership by Citibank/Fannie Mae there was NO CHARGE to the Big Banks for Deed transfers, etc. — they didn’t have to pay hook-up fees, SDC’s when the property does sell. IF there is a business/individual that wants to improve/invest in these types of properties … is there possibility of waiver of any accumulated fees .. can understand paying the standard “hook-up” to City services (water or sewer) on a property — but feel that if City feels a new owner should pay any “past due” fees for the years a property sat vacant and bumped through the foreclosure system — that should NOT be an additional expense to a new owner.

 

Will hope that on Monday we could receive some $$ amount (at least a estimate/range) of what a new owner would need to bring into start process to use this as a commercial property.

Thanks for the answers — From what I know now, a representative from ServiceLink will be contacting utility department/finance to determine if there are any outstanding sewer/water billings.

 

With services “turned off” — asking what it will take to have water turned on — and you state there is a sewer lateral in Leroy Street — but can City determine if the property was ever connected to the public sewer?

 

Previous owner names: CATES, Timothy .. owned until 2/27/2003 — when he sold to GRABER, Nancy & James; who sold to TEN BRIDGES LLC on 11/15/2016.

 

Hoping the Finance people might be able to verify whether or not there are any outstanding utility billings — and also “if” they can determine if the billings were just for water use … or sewer/water billings, etc.

There is a sewer lateral to the property. According to our records, this property has been disconnected from City services since 2003. Since it has no service it will likely be deemed by the Building Official as uninhabitable. In order to correct the issue and restore services, the owner will need to reestablish services, connect any services not currently connected (ie sewer), and then they will be able to move forward with the sale. Otherwise they will be selling a property that is not habitable and the new owners will have issues connecting to services. I am not sure at this time if they owe the City any back fees for services and will ask Finance to verify all costs to reestablish or establish water and sewer service to the property. Thanks.

Hi Aldo & Gerald … sending you both this email, as you both may have some of the answers.

This property is under contract to sell (currently owned by Citibank. N.A.). I am representing the Buyer.

The title services are being handled by ServiceLink, located in Irvine, CA. They should be contacting City of Molalla to verify if the property transfer will comply with any City requirements, etc.

Can Public Works determine if this property has been connected to City sewer line. (It does have City water service) I am thinking this is one of the properties that received notices a few years back requiring connection to public sewer — and my recollection is that City will require connection prior to transfer of ownership.

ServiceLink is supposed to be contacting City to determine if there are any factors/items that might require a compliance certificate or City report. They will also check with Ginger in utilities to see if there is outstanding utility billings.

Question: Will City of Molalla require the current owner (who received the property foreclosure / Sheriff’s Deed in Feb 2018) to pay for connecting this residence (with commercial zoning) to public sewer line prior to closing? … or has the property already been connected?
