Finally got to look at the pictures. It isn’t clear if they maintained the setback from Bear Creek per the code and if they are doing work of that size they probably were required to take out a DEQ 1200-C permit. They may have also filled in wetlands by rocking over it.

My recommendation would be to tell them not to continue any work until they get through the process with Planning, Public Works, DEQ and DSL. If they do continue then they will be opening themselves up to potential violations and fines by DEQ, DSL, and the City. As we’ve recently seen, DEQ is hammering companies who violate 1200-C and wetland rules.

Hi,

Mr. Marson called me today and would like to talk to us about what he and his contractors are doing on the site.

He would like to have a meeting early morning June 2 or late afternoon June 2. I haven't called him back yet. I need to tell him that we will require the site to be paved. I need to familiarize myself again with the code requirements. He will also need to treat stormwater.

I visited the site today and took these pictures. You can see they have newly graveled the site and have placed large poles for future lighting.
