Ok we have to put in a double ramp. Do either of you have any extra money to pay the contractor a little extra to instead of putting in a single ramp to put in a double ramp?

Hi Loretta,

It appears that sending pedestrians into a driveway, commercial or otherwise, is missing from the Feb 7 Guidelines. Pedestrians being directed in to a driveway where backing out and turning movements into and out of the driveway may exist seems to me to be inherently dangerous for pedestrians. My recommendation would be to allow for the crosswalk to be forced to the east side of the T intersection at Stowers and Hwy 211 and I can authorize the removal of the north side street tree within the ROW to make this intersection safer for pedestrians.

I looked at the guidelines for closing a x-walk. It does not look possible to close a x-walk at this location. See attached.

How do you want to proceed? Evidently the contractor will not put in 2 ramps unless he gets more money. Is there any money available? Or should I just have them fill the hole in with asphalt or gravel or something?

Attached is example of T intersection crosswalk closure request that can be supported by Region Traffic. Also there is guideline documentation that we use to determine when/where and what condition would warrant the consideration of a legal closure request that can be approved. It could be hard to justifying reasons to legally close the crossing at OR211 & Stowers Rd. Please call me to discuss further before submitting application.

There is no development plan that I can send you. The contractor went to work without a permit. The contractor dug out the existing ramp and now there is a hole. We need to get a ramp back in there.

Hello Mony, I would like to discuss this crosswalk closure with you. A little bit of the background on this is in the email below. This was a private development where they walked away over 2 years ago (before the ADA law suit) and did not finish their frontage improvements. The city was able to convince the contractor in to coming back and finishing the ADA ramp. Both the city and ODOT want to put in a one way ramp across Stowers. The reason for this is because across Main street (HWY 211) peds would be led in to the middle of a driveway. Because this is private development there is no nexus to make them do the ADA ramps on every corner. Requiring the private development to put in a bunch of other ADA ramps could cause a Nolan/Dolan case on the proportionality test which could cause ODOT to be sued. So we are looking at the southwest corner only. Would you be willing to do the crosswalk closure paper work? Please call me so we can discuss. We can meet if you like.

Yep, I don’t think ODOT will be able to get this from the contractor. The project is about 2 years old and they have come back in to finish but we have no hammer to hold them to this level of survey, design, and construction for a simple ramp replacement. Thanks.
