Hi Marah,

Just wanted to clarify something.

“10ft slope and utility easement from the new right of way line shall be provided to ODOT along the entire Yaw property frontage as necessary to accommodate the 3 lane planned cross section in the Molalla Transportation System Plan. The easement must be to the State of Oregon, Oregon Department of Transportation. The ODOT District 2B contact will assist in coordinating this process. The applicant shall notify the local jurisdiction when this requirement is fulfilled.”

I’m confused about this requirement in that, in my experience, an easement like this will be dedicated on the plat (or we will not approve the plat). The highlighted area seems to anticipate deed recording since the applicant would need to let us know. I’m just clarifying whether you are in agreement that the plat being recorded with this easement on it will suffice? Thank you and have a wonderful New Year!
