Yeah, I put the order in and noted on it that PW needs to call Jayson before installing the meter so he can be there. PW are reading meters today so not sure if they will get to it today or tomorrow.

Thanks Ginger,

Were you able to put the work order in to have the meter installed?

Hi Ginger,

Mac, Dan Z. and I discussed the history on this property and according to the piece of code below, the property owner can reestablish residential use in a commercial zone. See attached connection fee sheet, once paid we can issue their meter. I will reach out to the property owner and let the know what is required from them to reestablish service. Let me know if you have any question.

Sam,

Here’s the piece of code that applies to residential uses in commercial zones:

http://qcode.us/codes/molalla/view.php?topic=17-i-17_1_4-17_1_4_020&frames=off

D. Application of Code Criteria and Standards to Nonconforming Use. Once the City deems a use abandoned pursuant to subsection C, any subsequent use of the subject lot shall conform to the current standards and criteria of this Code. After the City has deemed a nonconforming use abandoned, the use shall not be allowed to resume, in whole or in part, under the same or different ownership or management; any such activity is a violation of this Code and subject to enforcement proceedings under Chapter 17-1.6. Residential uses in Commercial zones are exempt from this section.

Mac and I both read the last line to mean that residential uses in commercial zones effectively cannot be abandoned so the use can be (re)-established.

Best,

Dan Zinder
