Attachments: 1992 Hoyt Street Easement.pdf; Hi Dan, They will have to include construction of a waterline meeting our requirements and dedicate the sewer easement meeting the same description as the attached. Their building is currently over the top of an existing water, sewer, stormwater easement which is in violation of our easement rights. The way to correct is for a new waterline to be constructed and a public waterline easement to be dedicated. Once that is done then we will vacate the old water, sewer, stormwater easement north of the extension of the north ROW line of Hoyt Street which will bring them into compliance. Please let me know if you will need additional time. A couple of FYIs - The Applicant did not include the waterline and easement from the original submittals on their revised plans arguing that it was not a completeness item. Mac and I discussed the new waterline and easement and agreed with that determination. It can, however, be a finding/condition that the existing system is substandard and needs to be replaced w/ the appropriate easement. Also, AKS researched the sewer easement on Avison’s property and unfortunately this is another case where the document was finished but never recorded.
