Yes and we have to bring it up to current standards. Public Utility Easements can only be granted for franchise utilities such as PGE, NW Natural, etc. Public water, sewer, and stormwater lines on private property has to be in a 15’ wide public water easement, public sewer easement, or public stormwater easement. It is how our code and PW standards are set up. Thanks.

Hi Gerald - it appears there is an existing 27ft wide public utility easement over the water and sewer that are east-west in Fountain Way ( north of proposed Parcel 1) – are these the utilities you are referring to for the 15 ft easement?

We also need the public waterline and sewer line in a 15’ wide easement. These can be dedicated on the partition plat or be separate recording documents. If separate then I will need a legal description (Exhibit A) and map (Exhibit B). We have the cover forms and I can prepare and send those to you in a PDF if Al choses to record those documents separately. Thanks.

Hi Kelly,

I just left you a voicemail. We are scheduled out on our pre-apps until August 1. In lieu of trying to reschedule a pre-app, I would advise reaching out to Gerald Fisher at 503-759-0218. He has some comments to offer concerning the DRAFT preliminary plat you submitted. They relate to the need to include a 10-foot Public Utility Easement (PUE) along the frontage of Industrial Way. He will also ask you to include the existing 8-foot PUE along the frontage of OR-211 on the preliminary plat.

If you make the changes suggested by Gerald, I believe you are ready to submit a Partition Application with the City of Molala. Please use the form found here:

The fee for the application is $1,000. We are processing the partition applications as a staff-level--Type II review (even though our code currently says all partitions and subdivisions require review and approval by the Planning Commission). This allows the process to be a little more efficient for simpler applications.
