The 1000 ft view is it depends if the dedication necessitates the movement of the PUE and whether the resultant PUE would still encompass franchise utilities (water/sewer/storm should be in the ROW). If the PUE needs to be moved, the existing PUE can be extinguished with a new one established through the partition plat process. If after relocation of the PUE franchise utilities are no longer in the PUE then they will need to be relocated.

Expanding this chain to include ODOT for more specific feedback on dedication recommendations. Let me know if you have any outstanding questions from there and we can circle back.

Thanks Dan.

We got our survey yesterday and it shows there is an existing 10’ PUE along the right-of-way already, with utilities in it. We are still trying to reconcile the ROW width and whether a dedication is required/or how much… survey showed property line to center of street which doesn’t match 2003 survey online. How would a dedication and PUE work with the existing PUE and existing utilities? Will we be made to move those utilities will we?

Thanks for the update Jennifer,

Yes, 1.5x would be the multiplier for parking for this use. No adjacent on-street parking. You may include the patio space in leasable floor area.

That reminds me – outdoor uses are subject to a conditional use permit. Please include outdoor patio space as part of your CUP application. You won’t need to file an additional CUP for the patio space. Just include it in the CUP application already required for the drive-thru. I don’t foresee major considerations for the patio in terms of conditions other than obviously desirable elements such as providing shelter options such as an umbrella for outdoor seating and keeping the outdoor area in good condition.

I’ve attached a GIS snip of utilities around your site. X marks the spot for your subject parcel. I measure about 230 ft to your property line from the existing sewer north of Les Schwab and then another 60 to cross the ROW.

And to keep you updated, we just got the survey and are working on an updated site plan. We will provide that to you and ODOT when finished. We have discovered that Les Schwab driveway shown on the site plan was not accurate and the actual driveway is further north than what was shown.
