Hello Mac,

I apologize for the delay! As John probably mentioned, CBRE is an outsource partner for the Church of Jesus Christ of Latter Day Saints (the “Church”). We review all necessary documentation/proposals, prepare an analysis and work with the Church’s RE department to present to a Real Estate Committee who undertakes the request for consideration and raises to the Church’s leadership in certain instances.

Upon initial review of the project, the Church agrees that a slight expansion of the right of way makes good sense, as does the installation of sidewalks, curb and gutter from both a safety/aesthetic perspective. The did have a few questions prior to moving this forward to Committee for final review:

  1. 1. We understand that the road is being expanded to include a turn lane—is engineering available to understand what this looks like?

 

The engineering design is currently in process, we were hoping to find out if the Church was amenable to the ROW donation before we could determine how to design the portion along your frontage. That is to say, the roadway will be widened to include a lefthand turn lane that connects with the one currently ending at Hezzie Lane, east of your site, and continuing to Ona Way, west of your site. I’m including an As-Built of the roadway just east of your property, in essence the cross section shown will continue along your frontage to Ona Way. I also included a google earth map that shows what is happening to the east; the Church is circled and the little bus icon is at Ona Way. I think it’s important to note here that the roadway widening is going to occur with our without the ROW dedication. It’s just without the ROW dedication there will be a gap in the sidewalk along your frontage.

  1. 2. What will the timeline for the project be for completion?

 

The project is part of a public/private partnership with the developer improving the property adjacent to the west of the Church. They are chomping at the bit to get it done because they cannot begin their development until substantial completion of the improvements. With that said, I would eat my hat if it takes longer than a few months from the date all documentation is completed. However, I do not have a construction schedule at present, but we are reviewing the non-roadway parts of their civil submittals now and they have their land use approvals in-hand.

  1. 3. Entrance and exit for congregation members will not be impeded by the work, correct?

 

It will actually be improved by providing a left hand turn lane that will serve your site and providing safe pedestrian and bicycle access which reduces risk for motorists coming and going on your site and for bike/ped members to access your site.

  1. 4. The Church asks that no work occurs on Sunday—will this be an issue?

 

Our standards only allow work M-F during the day, no weekends or holidays. Night work permits are sometimes granted on the Highway to avoid traffic conflicts, but that would be more of a benefit than a detriment in this case, and will not be allowed on a Sunday.

  1. 5. Can this expansion be accomplished via a Quit Claim Deed? The Church prefers not to enter/execute Special Warranty Deeds.

 

We only require a right-of-way dedication, which basically dedicates that portion to the jurisdictional authority of the roadway, in this case the Oregon Department of Transportation because it is a state highway. We will provide you with all of the requisite documentation and the legal of the dedication. I anticipate this to be 4 feet, but survey would flesh that out entirely, and it would not be some drastically different amount, you can see where the sidewalk runs in the google picture.

Hi John,

I’m reaching out to discuss the LDS Church property located at 974 W Main St., Molalla, OR. W Main St. is also known as Oregon Highway 211 and carries a significant traffic load, while at the same time serving many pedestrians and bicyclists en route to and from multiple residential, commercial and community establishments like yours.

A developer has recently purchased the property adjacent to the west of the church site and, as part of their land use approvals, will be required to complete improvements along their W Main St. frontage which includes sidewalk, curb, and gutter. This will leave a sidewalk gap along the church frontage that is both less safe and less aesthetically pleasing. The City is prepared to foot the bill and manage the project to complete the sidewalk in front of the church, but have one hurdle we’re hoping you can help with.

The current Right-of-Way (ROW) in front of the church is 30 feet from centerline and the cross section for this major arterial is 34 feet from centerline. We’re hoping that in exchange for the city building the improvement,the church will consider dedicating the four additional feet of ROW necessary to complete the improvement. The city would take care of all legal documentation for the ROW dedication, build, and pay for the improvement, all we need from the church is to agree to the dedication and sign the dedication documents once approved by the Church’s legal counsel.

I’ve included a couple of visual aids to help conceptualize what I’m referencing, and would very much like to have a conversation with you, or the appropriate authority from your organization, in the near future as we are in the process of working through design on the adjacent project and would very much like to include the additions I mentioned.
